Section shall become ineffective as between the parties hereto. <br /> 18. Notices. Whenever in this Commercial Lease Agreement notice is to be given to <br /> the Lessee by the Lessor or to the Lessor by the Lessee, such notice shall be by certified mail <br /> directed to the Lessee at 2224 S. Stuhr Road, Grand Island, Nebraska 68801 or the Lessor at <br /> 5766 W. Stolley Park Road, Alda, Nebraska 68810 and notice so sent shall be considered as <br /> notice to the Lessee or the Lessor. The mailing of such notices shall be considered as delivered to <br /> the other party when such notice is placed in the United States mail. <br /> 19. Successors and Assigns. It is mutually covenanted and agreed by and between the <br /> parties hereto that this Commercial Lease Agreement and all the covenants and provisions,terms <br /> and conditions herein contained shall inure to the benefit of and be binding upon the successors <br /> and assigns of each of the parties hereto. <br /> 20. Modification. It is agreed that no change or changes shall be made in this <br /> Commercial Lease Agreement except in writing signed by the parties hereto, setting forth the <br /> terms of the agreed modification. <br /> 21. Construction of Commercial Lease Agreement. This Commercial Lease <br /> Agreement shall be construed in accordance with the laws of the State of Nebraska and in the <br /> event any provision herein contained shall be deemed by a court of competent jurisdiction to be <br /> void or unenforceable,this Commercial Lease Agreement shall be construed as though such void <br /> or unenforceable provisions were not a part hereof. <br /> 22. Representation. The law firm of Smith,Johnson, Baack, Placzek, Allen, Connick <br /> & Hansen (the "Law Firm")has been requested by both Lessor and Lessee to prepare this <br /> Commercial Lease Agreement. The Lessor and Lessee hereto acknowledge that they have <br /> negotiated the terms of this agreement without the aid or assistance of the Law Firm and the Law <br /> Firm's role is to prepare this Commercial Lease Agreement. As a result of this representation, in <br /> the event there is a dispute in the interpretation of this Commercial Lease Agreement or any <br /> other documents prepared in this undertaking,the Law Firm may be placed in a position where it <br /> may not be able to represent either the Lessor or Lessee in this Commercial Lease Agreement. <br /> The Lessor and Lessee hereto acknowledge that they have been made aware of this potential <br /> conflict in preparation of this Commercial Lease Agreement and all other documents pertaining <br /> to this Commercial Lease Agreement by Attorney Andrew Rubin. The Lessor and Lessee <br /> specifically waive this potential conflict in the preparation of this Commercial Lease Agreement. <br /> IN WITNESS WHEREOF,the parties have executed this Commercial Lease Agreement <br /> on the date noted above. <br /> 5 <br />
