1. The aforesaid construction and demolition waste disposal area shall be operated and <br /> maintained in conformance with the following: <br /> a. Applicant's site plan and construction plans attached hereto and dated January <br /> 2017; and <br /> b. Applicable permits issued to Applicant by the Nebraska Department of <br /> Environmental Quality. <br /> 2. Applicant shall not conduct or permit a use of the Property that results in a nuisance <br /> or an unreasonable hazard to adjacent land owners or to the general public. In furtherance of <br /> said goals, Applicant shall: <br /> a. Plant trees along the north property line from the water tower east to 70th Street <br /> and from that point south along 70th Street to the driveway; and <br /> b. Construct berms as shown on the attached site plan. <br /> 3. The Property must, at all times, be kept in a neat condition. <br /> 4. The Applicant shall comply with all applicable county, state and federal laws and <br /> regulations including, but not limited to, those pertaining to building and construction codes and <br /> standards, surface water and ground water quality, surface water drainage and flood control and <br /> protection, and environmental quality and protection. Nothing in the grant of this conditional <br /> use shall be construed as a grant of right, authority or permit to allow any use of the land, <br /> materials, actions or materials which violate any state or federal law or rule or regulation of a <br /> federal, state or local agency other than as is specifically set forth herein. <br /> 5. Upon request by the County, Applicant shall permit access to the Property by the <br /> County Zoning Administrator and/or other designated county agents and/or representatives for <br /> the purpose of inspecting said property and determining compliance with this resolution. <br /> 6. Applicant shall supply to the County Zoning Administrator a copy of any notices or <br /> correspondence received by Applicant from the Nebraska Department of Environmental Quality <br /> relating to the construction, operation, maintenance, alteration or discontinuance of said <br /> construction and demolition waste disposal area, including, but not limited to, any notice of <br /> actual or possible violation of state laws or regulations. Said copies shall be provided within ten <br /> (10) days of receipt by Applicant. <br /> 7. The term of this conditional use permit shall be for a period of seven (7) years <br /> commencing with the issuance of the permit to be issued by the Nebraska Department of <br /> Environmental Quality, but may be terminated if Applicant fails to comply with any of the <br /> conditions set forth herein. In the event of noncompliance, the Hall County Board of <br /> Supervisors shall notify Applicant in writing setting forth the specific areas of noncompliance. <br /> If Applicant fails to cure said noncompliance within thirty (30) days after receiving said notice, <br />
