RESOLUTION#17- 0 0 L <br /> A RESOLUTION GRANTING A RENEWAL APPLICATION FOR THE CONDITIONAL <br /> USE OF A TRACT OF LAND LOCATED IN THE <br /> SOUTHEAST QUARTER OF THE NORTHEAST QUARTER(SE 1/4 NE 1/4) <br /> OF SECTION TWENTY-THREE(23),TOWNSHIP TEN (10)NORTH, <br /> RANGE TEN(10) WEST OF THE GTH P.M.,HALL COUNTY,NEBRASKA <br /> WHEREAS, Bosselmman, Inc., hereinafter referred to as Applicant, is the owner of the Southeast <br /> Quarter of the Northeast Quarter(SE 1/4 NE 1/4)of Section Twenty-Three(23), Township Ten(10) <br /> North, Range Ten(10) West of the 6th P.M., Hall County, Nebraska, hereinafter referred to as the <br /> "property"; and <br /> WHEREAS, applicant has made it's written renewal application for a permit to use the <br /> above-described property for the operation and maintenance of sewage treatment lagoons; and <br /> WHEREAS, said property is located within the AG-1 Agricultural Zoning District; and <br /> WHEREAS, on January 24, 2017, following due and proper notice, the Hall County Board of <br /> Supervisors held a public hearing upon said renewal application;and <br /> WHEREAS,pursuant to the Hall County's Zoning Resolution,the Hall County Board of Supervisors <br /> is empowered to grant an application for conditional use upon a determination that the purposed use is <br /> consistent with the intent of the AG-1 Agricultural Zoning District. <br /> NOW,THEREFORE,BE IT RESOLVED that,upon consideration of the evidence presented and the <br /> factors to be considered pursuant to Subsection d. of Section 11 of the Zoning Resolution, the use of <br /> the aforesaid property for the operation and maintenance of sewage treatment lagoons,as conditioned <br /> hereby,is found to be consistent with the intent of the AG-1 Agricultural Zoning District and that the <br /> renewal application for conditional use be hereby granted subject to the following conditions, <br /> limitations and restrictions: <br /> 1. The aforesaid sewer treatment lagoons shall be operated and maintained in conformance with the <br /> following: <br /> • applicable permits issued to Applicant by the Nebraska Department of <br /> Environmental Quality and the United States Army Corps of Engineers; <br /> • Applicant's site plan,attached hereto,and construction plans dated May 14, 1996; <br /> • The lagoon cross-section drawing dated October 24, 1996; and <br /> • <br /> • The flood plain study and drawings dated October 18, 1996. <br /> 2. Applicant shall not conduct or permit a use upon the property that results in a nuisance or an <br /> unreasonable hazard to adjacent landowners or to the general public. <br /> 1 The real estate must, at all times,,be kept in a neat condition. <br /> 4. The Applicant shall comply with all applicable county, state and federal laws and regulations <br /> including,.but not limited to, those pertaining to building and construction codes and standards, <br /> surface water and ground water quality, surface water drainage, flood control and protection, and <br />
