<br />HALL COUNTY BOARD OF SUPERVISORS MEETING, OCTOBER 13, 1992

<br />The Hall County Board of Supervisors met at 9:00 A.M. from adjourned session
<br />and by published call with Chairperson Margaret Landis presiding.
<br />
<br />Present on roll call were Irene Abernethy, Richard Frauen, Richard Hartman,
<br />Margaret Landis, Robert Leslie, Gary Quandt, and Bill Wright. None were absent.
<br />
<br />Invocation'was given by Abernethy.
<br />
<br />Pledge of Allegiance was given.
<br />
<br />Minutes of October 6th meeting were accepted as received, on motion by Frauen,
<br />seconded by Abernethy. On roll call vote Abernethy, Frauen, Hartman, Leslie,
<br />Quandt, Wright and Landis voted yes, none voted no. Motion carried.
<br />
<br />Deputy County Attorney Jerry Janulf'wicz was present. He presented Resolution
<br />Conditional Use Permit for Nebraski Cellular Telephone Corporation.
<br />Motion by Frauen, seconded by Hartman to adopt Resolution #1431 as pre-
<br />sented. On roll call vote Abernethy, Frauen, Hartman, Leslie, Quandt, Wright
<br />and Landis voted yes, none v:>ted no. Motion carried.

<br />A RESOLUTION GRANTING THE APPLICATION FOR A CONDITIONAL USE OF.
<br />CERTAIN PROPERTY LOCATED IN THE NORTHWEST QUARTER (NW!) OF SECTION
<br />SEVENTEEN (17), TOWNSHIP NINE (9) NORTH, RANGE TWELVE (12) WEST OF
<br />THE 6TH P. M., HALL COUNTY, NEBRASKA.

<br />WHEREAS, Nebraska Cellular Telephone Corporation, as lessee, hereinafter
<br />
<br />referred to as "applicmt," has made its written application for the erection,
<br />
<br />operation, and maintenance of a radio communications tower upon the following
<br />
<br />described premises, to-wit:
<br />
<br />A parcel of land loeated in the Southwest Corner of Lot Four (4) on
<br />Island in Northwe~:t Quarter (NW!) of Section Seventeen (17) ,
<br />Township Nine (9) Horth, Range Twelve (12) West of the 6th P.M.,
<br />Hall County, Nebraska;
<br />
<br />and,
<br />
<br />WHEREAS, said property is located within the AG-1 Agricultural Zoning
<br />
<br />District; and,
<br />
<br />WHEREAS, a public hearing was held on the 22nd day of September, 1992 by
<br />
<br />the Hall County Board of Supervisors upon the a ~oresaid application following due
<br />
<br />and proper notice of the same to the public; and,
<br />
<br />WHEREAS, the Hall County Board of Supervisors is empowered pursuant to the
<br />
<br />Hall County Zoning Resolution to grant an application for a conditional use upon
<br />
<br />a determination that the proposed use is a permitted conditional use within the
<br />
<br />zoning district or that the proposed use is consistent with the intent of the AG-
<br />
<br />1 Agricultural Zoning District.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED that the use of the aforesaid property for
<br />
<br />the erection, operation and mainteriance of a radio communications tower is found
<br />
<br />to be consistent with the intent of the AG-l Agricultural Zoning District and
<br />
<br />that the application for conditional use is hereby granted subject to the
<br />
<br />following conditions, limitations, and restrictions:
<br />(A) All waste, rubbish and debris must be completely cleared from the
<br />
<br />above described real estate as soon as practical and said real estate must, at
<br />
<br />all times, be kept in a clean and neat condition as to be presentable to the
<br />
