Regional Planning Director Chad Nabity stated that this is the recommendation from the planning commission regarding the zoning regulations on adult establishments. They held a public hearing October 7, 2015 and had a presentation from Scott Bergthold and all of the members received a CD that was part of the official packet of all of the information and research. He read the recommendation and noted there were some wording changes. He stated the proposed amendments are needed and justified and consistent with comprehensive plan and recommends approval of the proposed amended zoning regulations. 9. DISCUSSION ABOUT AND SET DATE FOR FURTHER PUBLIC HEARING ON ZONING AMENDMENT PROPOSAL (DESCRIBED IN ABOVE AGENDA ITEM) BEFORE COUNTY BOARD ON NOVEMBER 3, 2015 - Lancaster made a motion and Purdy seconded to set the public hearing for November 3, 2015 at 10:30 a.m. regarding the proposal for amendments to the zoning regulations pertaining to adult establishments. Arnold. Lancaster, Lanfear, Purdy Quandt, Richardson and Schuppan all voted yes and none voted no. Motion carried. 10. FIRST READING OF PROPOSED NEW COUNTY ORDINANCE GOVERNING PUBLIC NUDITY AND LEWD AND LASCIVIOUS CONDUCT, AS UPDATED AT MEETING OF SEPTEMBER 22, 2015—Attorney Brandy Johnson with Vince Valentino's office was present regarding the Shane Harrington litigation matter. She read the proposed resolution and the ordinance. ORDINANCE NO. AN ORDINANCE TO ESTABLISH A LAW REGARDING PUBLIC NUDITY AND LEWD OR LASCIVIOUS BEHAVIOR; TO ESTABLISH A PENALTY AND PROVIDE A METHOD OF ENFORCEMENT; AND TO PROVIDE FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Neb. Rev. Stat. §23-104, the County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers; WHEREAS, pursuant to Neb. Rev. Stat. §23-103, the powers of the County as a body are exercised by the Hall County Board of Supervisors("County Board"); WHEREAS, it is the intent of the County Board to enact an Ordinance; WHEREAS, pursuant to Neb. Rev. Stat. §23-187, the County may regulate, through an ordinance, violations of the public peace and good order of the County by public nudity and/or lewd or lascivious behavior; and, WHEREAS, the Hall County Board has held a public meeting on the matter, after giving due notice as required by law.
