9:05 a.m. Held a Board of Equalization meeting <br /> 9:20 a.m. Adjourned the Board of Equalization and returned to the regular meeting. <br /> PUBLIC PARTICIPATION —Chairman Arnold called for public participation and no one <br /> responded. <br /> 4. COUNTY ATTORNEY - DISCUSSION & POSSIBLE ACTION ON CONDITIONAL USE <br /> PERMIT APPLICATION OF WATERS VIEW INCNONTZ PAVING, INC. <br /> County Attorney Jack Zitterkopf noted that the public hearing was held and the parties <br /> requested additional time to discuss a settlement and it has not been reached so the County <br /> Board has to make a decision. The board has to say yes or no to grant the permit and they <br /> have to state the actual reasons for that vote. There is no resolution prepared for today but it <br /> will reflect what is done today to approve or not approve the permit and state the reasons and <br /> comply with state statutes. He also noted that if the board votes today, the appeal time would <br /> start. <br /> Arnold asked if the conditions had to be stated and Mr. Zitterkopf stated the conditions would <br /> have to be included in the motion and the reasons. <br /> Chairman Arnold noted there is a Board of Corrections meeting scheduled and this will be <br /> addressed and then return to this item. <br /> 9:30 a.m. Held a Board of Corrections meeting <br /> 9:41 a.m. Adjourned the Board of Corrections meeting and returned to the regular meeting. <br /> Schuppan made a motion and Lanfear seconded to approve the conditional use permit for <br /> Waters View IncNontz Paving, Inc. <br /> Lancaster stated she has done research talked to Mr. Vontz and to the other side she noted that <br /> there are people that are opposed to the location and people that are opposed that have no <br /> economic interest. She noted that when Bosselman's constructed their new entrance they also <br /> had to move their entrance. She noted the following concerns: <br /> • Traffic volume could be a safety issue <br /> • Concern on the noise <br /> • Asphalt plan emissions and odors <br /> • Concern on the compatibility of the surrounding land use <br /> • Crane Trust was there first and it infringes on their ability for development <br /> She also noted that there were people from other counties but she is responding to the Hall <br /> County people. She is opposed to the conditional use permit. <br /> Richardson noted that Mr. Zitterkopf advised the board to include the reasons in the motion. <br /> Arnold stated this would be added as the board moves forward. <br /> Arnold stated he has received more input on this issue than anything else and he looked at the <br /> following: <br /> • Crane Trust is on an interchange on 180 the busiest corridor in the county <br /> • Does not consider noise an issue because of 180 traffic <br /> • Increased traffic, the drivers will be aware of traffic issues <br /> 3 <br />
