line of said railroad track easement, a distance of Three Hundred Two and Five <br /> Tenths (302.50) feet; thence running northwesterly, along and upon the westerly <br /> line of said railroad track easement, and being along and upon the arc of a curve to <br /> the right whose radius is 621.33 feet, a distance of Four Hundred and Nine <br /> Hundredths (400.09) feet (long chord = 393.22', long chord bearing <br /> N26°45'23W) to a point on a north line of said "TRACT NO. 26A," thence <br /> N89°36'07"W, along and upon a north line of said "TRACT NO. 26A," a distance <br /> • of Fifty and Nine Tenths(50.90) feet to the northwest corner of said"TRACT NO. <br /> 26A," said point also being on the west line of said Southwest Quarter(SW 1/4); <br /> thence S00°23'27"W, along and upon the west line of said "TRACT NO.26A,"and <br /> also being along and upon the west line of said Southwest Quarter (SW 1/4), a <br /> distance of Two Thousand Three Hundred Sixty and Three Tenths (2,360.30)feet <br /> to the point of beginning; and <br /> WHEREAS, applicant has filed a renewal application to use the above-described property for <br /> processing concrete, asphalt and wood for reuse as crushed materials and erosion control mulch; <br /> and <br /> WHEREAS, the above-described property is located in a district presently zoned for AG-SI use; <br /> and <br /> WHEREAS,the proposed conditional use in a district zoned AG-SI is a permitted conditional use <br /> pursuant to Appendix A, Zoning Matrix, of the Zoning Resolution of Hall County, Nebraska, as <br /> amended; and <br /> WHEREAS, the proposed conditional use is consistent with the Cornhusker Army Ammunition <br /> Reuse Plan; and <br /> WHEREAS, on July 28, 2015, a public hearing on said application was held by the Hall County <br /> Board of Supervisors upon due and proper notice of said hearing; and <br /> WHEREAS,at said public hearing the public was given the opportunity to speak in favor of and in <br /> opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the <br /> conditional uses within the AG-SI Zoning District; that such use, as limited herein, will not <br /> adversely affect the public interest;and that said Board is empowered under the Zoning Resolution <br /> to permit such conditional use. <br /> NOW,THEREFORE,BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, <br /> Nebraska, the Hall County Board of Supervisors hereby grants to Hooker Brothers a Conditional <br /> Use Permit to use the above-described real estate for the purpose of processing concrete, asphalt <br /> and wood for reuse as crushed materials and erosion control mulch, subject to the following <br /> conditions and restrictions: <br />
