RESOLUTION# 15- 0 3 <br /> A RESOLUTION GRANTING A CONDITIONAL USE PERMIT <br /> FOR THE USE OF A TRACT OF LAND LOCATED IN THE EAST HALF <br /> OF THE NORTHEAST QUARTER AND THE SOUTHWEST QUARTER <br /> OF THE NORTHEAST QUARTER OF SECTION 28, TOWNSHIP 11 NORTH, <br /> RANGE 11 WEST OF THE GTH P.M.,HALL COUNTY,NEBRASKA <br /> WHEREAS, Mike Dobesh, hereinafter referred to as "applicant," is the owner of a parcel of real <br /> estate located at 11163 West Stolley Park Road, Wood River, Nebraska, and described as the <br /> East Half of the Northeast Quarter and the Southwest Quarter of the Northeast Quarter of Section <br /> 28, Township 11 North, Range 11 West of the 6th P.M., Hall County, Nebraska, hereafter <br /> referred to as the "property";and <br /> WHEREAS, applicant has made written application to use the property for the storage and retail <br /> sale of anhydrous ammonia, the weighing of liquid fertilizer, and for storage of tanks and <br /> equipment related to the described activities; and <br /> WHEREAS, the above-described property is located in a district presently zoned for AG-1 <br /> Agricultural use; and <br /> WHEREAS, the proposed conditional use in a district zoned AG-1 is a permitted conditional use <br /> pursuant to section 5, paragraph 1.c. of the Zoning Resolution of Hall County, Nebraska, as <br /> amended;and <br /> WHEREAS, on February 24, 2015, a public hearing on said application was held by the Hall <br /> County Board of Supervisors upon due and proper notice of said hearing; and <br /> WI=IEREAS, at said public hearing the public was given the opportunity to speak in favor of and <br /> in opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the <br /> conditional uses within the AG-1 District; that such use, as limited herein, will not adversely <br /> affect the public interest; and that said Board is empowered under the Zoning Resolution to <br /> permit such conditional use. <br /> NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, Nebraska, the <br /> Ilall County Board. of Supervisors hereby authorizes the conditional use of the above-described <br /> property for the storage and retail sale of anhydrous ammonia, the weighing of liquid fertilizer, <br /> and for storage of tanks and equipment related to the described activities subject to the following <br /> conditions: <br /> 1. The above-described real estate shall be used solely for the storage and retail sale of <br /> anhydrous ammonia, the weighing of liquid fertilizer, and for storage of tanks and equipment <br /> related to the described activities. The premises shall be maintained in a neat and clean <br /> condition at all times, free of debris and inflammable waste materials. <br />
