<br />The Hall County Board of Supervisors met at 9:00 A.M. from adjourned session
<br />and by published call with Chairperson Margaret Landis presiding.

<br />Present on roll call were Irene Abernethy, Richard Frauen, Richard Hartman,
<br />Margaret Landis, Robert Leslie, Gary Quandt and Bill Wright. None were absent.
<br />
<br />Invocation was given by Abernethy.
<br />
<br />Pledge of Allegiance was given.
<br />
<br />Minutes of April 28th meeting were accepted as received, on motion by Quandt,
<br />seconded by Frauen. On roll call vote Abernethy, Frauen, Hartman, Leslie,
<br />Quandt, Wright and Landis voted yes, none voted no. Motion carried.
<br />
<br />Deputy County Attorney Jerry Janulewicz was present. He spoke in regard to
<br />the request from Building & Grounds employees to withdraw from the union
<br />bargaining unit. County Board needs to ratify the withdrawal of recogni-
<br />tion. Letter has been sent by Attorney Pigs ley to Union Represeneative' Kelly
<br />on April 30th.
<br />Motion by Quandt, seconded by Frauen to ratify the withqrawal. 6f recognition
<br />of C.W.A. as union bargaining unit for Building & Grounds Department. On roll
<br />call vote Abernethy, Frauen, Hartman, Leslie, Quandt, Wright and Landis voted
<br />yes, none voted no. Motion carried.

<br />Tort Claim from J. Thomas Rowen on behalf of Dail A. Helzer was presented.
<br />Claim was filed by Dail A. Helzer for and on behalf of herself and her four
<br />children for damages sustained by them arising out of an accident on August
<br />19, 1991 on Schauppsville Road in Hall County, Mayfield Township Nebraska,
<br />between their vehicle and a Burlington Northern Railroad train. Claim made
<br />against Hall County for its negligence to keep grass and shrubs adequately .
<br />trimmed togive proper visibility at the mentioned railroad crossing. Request
<br />for damages, general and special, which are ongoing and cannot be further
<br />specified in this notice of claim.
<br />Motion by Quandt, seconded by Hartman to refer to County Attorney's
<br />office and Ellen Merrilll Board Assistant and Insurance representative. On
<br />roll call vote Abernethy, Frauen, Hartman, Leslie, Quandt, Wright and Landis
<br />voted yes, none voted no. Motion carried.

<br />Discussion on contract to have pay telephone installed at County Office Build-
<br />ing. Postponed action for two weeks as need additional research. Board
<br />Assistant, Deputy County Attorney and Communication Civil Defense Director to
<br />do the research and return with recommendation.

<br />Robert Schwartzkopf, Weed Control Authority Superintendent presented infor-
<br />mation on weed control protest. He presented a letter from Deputy County
<br />Attorney that legal steps were followed on the forced weed control protest
<br />against Don Denman for $199.69
<br />Set May 19, 1992 at 1:45 P.M. for hearing for Mr. Denman to appear and
<br />state his side of the matter. Weed Control Superintendent to send notice
<br />to Mr. Denman.
<br />
<br />Renewal Application for Public Officials Liability Insurance Coverage was
<br />presented for Chairman signature.
<br />Motion by Quandt, seconded by Frauen to authorize Chairperson to sign
<br />the renewal application. On roll call vote Abernethy, Frauen, Hartman, Leslie,
<br />Quandt, Wright and Landis voted yes, none voted no. Motion carried.

<br />Recessed for Board of Equalization at 9:48 A.M. and returned to regular session
<br />at 9:54 A.M.
