APPROVAL CRITERIA 2.1 Any applicant seeking to have its location ,aPIProVedtlbYt the Ball County Board of supervisors as a keno sa es ou .e shall meet the following criteria in order to rece~ve approval. 2.1.1 Shall have entered into a ~ritten agreement,or a written option to enter int~ ~ wr~tten agreemen~ w~th a keno lottery operator perta~n~ng to the operat~on of a keno sales outlet at applicant's location; 2.1.2 Shall have sufficient physical facilities to permit the sale of keno tickets; 2.1.3 Shall have seating capacity and available ~ sufficient to accommodate members of the general publ~c who may wish to come to the location to observe or play the game of keno or the engage in any other activity conducted on the premises; 2.1.4 Shall have a board or other m~ni~or clearly visible to the players on which the w~nn~ng keno numbers are displayed; 2.1.5 Shall have a security plan for the keno operations which plan shall have been approved by the lottery operator and the county keno administrator; 2 . 1.6 The applicant and or person having direct or indirect ownership interest in the applicant must be of good character and financially responsible; 2.1.7 Shall be in compliance with the State Fire Marshal's rules and regulations issued pursuant to Nebraska Revised Statute Section 81-502 as shown by the most recent fire safety inspection of the State Fire Marshal; 2.1.8 Shall be in compliance with all local building, plumbing, electrical and mechanical codes of the city, village, or county having zoning jurisdiction of the proposed location; 2. 1. 9 Shall have no federal, state, or county tax delinquencies, federal or state tax liens, or other tax compliance deficiencies, whether federal, state or local, against the applicant or the applicant's property; 2.1.10 If located within the boundaries of a city or village or if located within the two mile zoning jurisdiction area of the City of Grand Island, whether there is an inter local agreement between Ball County and the respective city or village which agreement authorizes the conduct of a keno lottery game at a keno sales outlet within the municipality or the zoning jurisdiction area in which applicant's proposed location is found; 2.1.11 Shall have no person having a direct or indirect ownership interest in the sole proprietorship, partnership or corporation who has been convicted of, forfeited a bond upon a charge of, or pleaded guilty to or nolo contendere to forgery, theft, extortion, conspiracy to defraud, willful forfeiture to make required payments or reports to a governmental agency, intentional filing of false reports to a government agency, or any similar offense or offenses or any crime, whether a felony or misdemeanor , involving gambling activity or moral turpitude under any state of federal law; 2.1.12 No location will be considered for approval if the person, sole proprietorship, partnership or corporation, or any person having direct or indirect financial interest in such sole proprietorship, partnership or corporation, is under investigation by an agency of the State of Nebraska or an aqencv of the
