<br />Attorney Januelwicz recommended the County Board accept the offer from Habitat
<br />for Humanity sale of Lot 5 Block 4 George Loan's Subdivision for $800.00.
<br />Motion by Hartman, seconded by Abernethy to accept the offer from Habitat
<br />for Hamanity and authorize chairman to sign the agreement. Abernethy,Frauen,
<br />Hartman, Leslie, Quandt and Stelk voted yes, none voted no, with Landis absent
<br />from the room. Motion carried.
<br />
<br />County Clerk presented the Tort Claim received February 26, 1993 in regard
<br />to the Amy Hilfiker Estate Claim for automobile/train collision at Union
<br />Pacific Railroad crossing on Monitor Road, south of Highway 30,located 2 miles
<br />east of AIda, Hall County Nebrska. Claim against Hall County is for$500,000.00
<br />Motion by Hartman, seconded by Frauen to receive the tort claim, table and
<br />Insurance company be notified. Abernethy, Frauen, Hartman, Landis, Leslie,
<br />Quandt and Stelk voted yes, none voted no. Motion carried.

<br />Motion by Frauen, seconded by Hartman to adopt Resolution #1467 as presented.
<br />Abernethy, Frauen, Hartman, Landis, Leslie, Quandt, and Stelk voted yes, none
<br />voted no. Motion carried.

<br />WHEREAS, there has been signed by Hall County on
<br />the 24th day of January , 19lL.., and the State on the 6th day
<br />of February , 19-"llL... an agreement providing for the construction of a
<br />
<br />FederalAid pro;ect beKinninK at the Southwest Cotner of Section 4,
<br />
<br />Township 9 North. Range 11 West.
<br />
<br />, and
<br />
<br />WHEREAS, in the above agreement, the County has pledged sufficient funds to
<br />finance its share of the cost of the construction of this project identified as
<br />No. STP-20BO (1) J and
<br />\
<br />
<br />WHEREAS, the above mentioned agreement provided that the County would pay
<br />all costs not paid for with Federal or State funds, and
<br />
<br />WHEREAS, the State received bids for the construction of this project on
<br />February 1B. 1993 at which time 6 bids were received for
<br />the construction of this proposed work, and
<br />
<br />WHEREAS, the following contractor(s) for the items of work listed has been selected
<br />as the low bidder(s) to wh~m a contract(s) should be awarded:

<br />Werner Construction Co.. Hastings. Nebraska;
<br />
<br />Bituminous: $579,667.44
<br />
<br />NOW THEREFORE, in consideration of the above facts, the Board of
<br />Supervisors of Hall County, by this resolution,
<br />takes the following official action:
<br />
<br />1. If for any reason the Federal Highway Administration rescinds, limits its
<br />obligations, or defers payment of the Federal share of the cost of this project, the
<br />County hereby agrees to provide the necessary funds to pay for all costs incurred
<br />until and in the event such federal funds are allowed and paid.
