<br />9~J='-3~5 <br /> <br />HALL- COUNTY BAORD OF SUPERVISORS MEETING - DECEMBER 27, 1994 <br /> <br />.~ <br /> <br />The Hall County Board of Supervisors met at 9:00 A.M. from adjourned <br />session and by published call with Chairman Richard Hartman presiding. <br /> <br />! <br /> <br />Present on roll call were Irene Abernethy, Richard Frauen, Richard <br />Hartman, Margaret Landis, Robert Leslie, Gary Quandt and Tammie Stelk. <br /> <br />Invocation given by Dr. Leslie. <br /> <br />Pledge of Allegiance was given. <br /> <br />Minutes of December 20th meeting were approved by motion of Quandt, <br />seconded by Abernethy. Abernethy, Frauen, Hartman, Landis, Leslie, <br />Quandt and Stelk voted yes, none voted no. <br /> <br />Conditional Use Permit for Aurora Coop resolution #1608 was approved <br />by motion of Quandt, seconded by Stelk. Abernethy, Frauen, Hartman, <br />Landis, Leslie, Quandt and Stelk voted yes, none voted no. <br /> <br />RESOLUTION # /~ tf) .f <br /> <br />A RESOLUTION AUTHORIZING THE CONDITIONAL USE OF A TRACT OF LAND <br />LOCATED IN THE NORTHEAST QUARTER (NEl/4) OF SECTION FIFTEEN (15), <br />TOWNSHIP TEN (10) NORTH, RANGE ELEVEN (11) WEST OF THE 6 th P.M., HALL <br />COUNTY, NEBRASKA <br /> <br />WHEREAS, Aurora .Cooperative Elevator Company of Grand Island. hereinafter referred to as <br />"applicant," is th~ owner of a parcel of real estate as described as Parcel 1 in Exhibit A. which is attached <br />hereto and incorporated herein by this reference. and the holder of an easement upon the parcel described <br />as Parcel 2 in Exhibit A; and <br /> <br />WHEREAS, applicant has made written applicatiQn to use the above. described property for the <br />stDrage and retail sale of anhydrous ammonia, liquid and dry fertilizer, and chemical products utilized fDr <br />agricultural purposes and for storage of tanks and equipment related to the operation of a retail fertilizer <br />and farm supply business; and <br /> <br />WHEREAS, the above described prDperty is located in a district presently zoned for AG-1 <br />Agricultural use; and <br /> <br />WHEREAS, the prDposed cDnditional use in a district zDned AG-1 is a permitted conditional use <br />pursuant to section 5. paragraph 1.c. of the Zoning ResolutiDn of Hall County, Nebraska, as amended; and <br /> <br />WHEREAS a public hearing Dn said application was held by the Hall County Board of Supervisors <br />upon due and proper notice of said hearing; and <br /> <br />WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and in <br />opposition to the application for conditional use; <br /> <br />NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, Nebraska, the Hall <br />County Board of Supervisors hereby authorizes the cDnditional use of the above-described prDperty for the <br />storage and retail sale of anhydrous ammonia, liquid and dry fertilizer, and chemical products utilized fDr <br />agricultural purposes and for storage of tanks and equipment related to the operation of a retail fertilizer <br />and farm supply business subject to the following conditions: <br /> <br />h The above described real estate shall be used solely for the storage and retail sale of anhydrous <br />ammonia, liquid and dry fertilizer. and chemical products utilized for agricultural purposes and for storage . <br />of tanks and equipment related to the operation of a retail fertilizer and farm supply business. The <br />premises shall be maintained in a neat and clean condition at all times, free of debris and inflammable <br />waste materials. <br /> <br />2. Owner shall comply with the Hall County Zoning Resolution. Hall County Subdivision Regulations. and <br />Hall County Building Codes with respect to the use of the above-described property. <br /> <br />3. The rights and privileges granted herein may be terminated for any act or acts on noncompliance with <br />the terms and conditions of this resolution. The Hall County Board of Supervisors shall provide written <br />notice to owner of any act or acts constituting noncompliance. Owner shall have 14 days to cure such <br />noncompliance. In the event owner fails to cure such noncompliance. the Hall County Board of Supervisors <br />may terminate or revoke the rights and privileges granted herein. <br />
