Abernethy, Frauen, <br />Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. Motion <br />carried. <br /> <br />Motion by Stelk, seconded by Abernethy to adopt Resolution #1544 as presented <br />and set the public hearing for March 1, 1994 at 10:00 a.m. Abernethy, Frauen, <br />Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. Motion <br />carried. <br /> <br />.3 <br /> <br />RESOLUTION # / ~-~f <br /> <br />WHEREAS, the County Board of Hall County, Nebraska, <br />hereinafter "County Board", was requested by various persons <br />to consider the abandonment or vacation of three portions of <br />county roads within Hall County, Nebraska, to-wit: <br /> <br />PRAIRIE ROAD: Beginning at the Southeast (SE) Corner of <br />the Southwest Quarter (SWl/4) of Section Th~ee (3), Township <br />Twelve (12) North, Range Ten (10) West; thence west to the <br />Southwest (SW) Corner of the Southwest Quarter (SWl/4), of <br />said Section Three (3), said right-of-way being 33' each side <br />of said section line. <br /> <br />MONITOR ROAD: Beginning at the Northwest (NW) Corner of <br />the Southwest Quarter (SWl/4) of Section Three (3), Township <br />Twelve (12) North, Range Ten (10) West; thence southerly two <br />and one-half (2-1/2) miles to a point forty-five (45) feet <br />north of the Southwest (SW) Corner of Section Fifteen (15) <br />Township Twelve (12) North, Range Ten (10) West, said right- <br />of-way being 33' each side of said section line. <br /> <br />CHAPMAN ROAD: Beginning at the Southeast (SE) Corner of <br />the Southwest Quarter (SW1/4) of Section Ten (10), Township <br />Twelve (12) North, Range Ten (10) West; thence west two and. <br />one-half (2-1/2) miles to the Southwest (SW) Corner of <br />Section Eight (8), Township Twelve (12) North, Range Ten (10) <br />West. <br /> <br />WHEREAS, pursuant to such request and by resolution of <br />the County Board, the Ball County Public Works Director was <br />directed to make a study of the use made of said roads and <br />submit his findings in writing to the County Board: and <br /> <br />WHEREAS, the County Public Works Director completed said <br />study and reported his findings to the County Board which <br />desires to hold a public hearing on the proposed abandonment <br />or vacation of the above-described portions of county roads. <br /> <br />NOW, BE IT RESOLVED, that a public hearing on the <br />abandonment or vacation of the above-described portions of <br />county roads shall come on before the County Board of Hall <br />County, Nebraska, on the 1st day of March, 1994, at 10:00 <br />o'clock a.m. at the County Board Room, Ball County <br />Administration Building, 121 South Pine Street, Grand Island, <br />Nebraska. At said public hearing members of the public who <br />wish to speak for or against the proposed abandonment or <br />vacation shall be permitted to address the County Board. <br /> <br />IT IS FURTHER RESOLVED that this resolution be published <br />once per week for three consecutive weeks prior to said <br />public hearing and that copies of this resolution be served <br />by certified mail upon the owner. of lands abutting on or <br />adjacent to the roads to be vacated or abandoned. <br /> <br />IT IS FURTHER RESOLVED that the County Public Works <br />Director request the township boards of the townships within <br />which the above-described roads are located to consent to <br />such abandonment or vacation and to waive, on behalf of said <br />townships, the relinquishment or reversion of said roads to <br />the townships. <br /> <br />.1 <br />
