<br />HALL COUNTY BOARD OF SUPERVISORS MEETING, NOVEMBER 21, 1995

<br />The Hall County Board of Supervisors _met at 9:00 A.M. in County Board Meeting
<br />Room of Administration Building,~12l"South Pine, on November 21, 1995 from
<br />adjourned session and by published Eall.
<br />
<br />Meeting was called to order by Irene Abernethy, Chairman.
<br />
<br />Invocation was given by Rev Dick Bacon, First Christian Church.
<br />
<br />Pledge of Allegiance was given.
<br />
<br />Present on Roll Call were Irene Abernethy, Margaret Landis, Robert Leslie,
<br />Gary Quandt, Judy Rosenkotter, and Tammie Stelk. Absent was Richard Hartman,
<br />He arrived at meeting at 9:15 A.M.
<br />
<br />Minutes of November 7th meeting were approved as recived. No meeting was
<br />held November 14th due to County Government Day.
<br />
<br />Motion by Stelk, seconded by Landis to adopt the Substance Abuse Policy for
<br />Hall County Handibus. Abernethy, Landis, Leslie Quandt, Rosenkotter and
<br />Stelk voted yes, none voted no, with Hartman absent. Motion Approved.
<br />
<br />Discussed the Political Subdivision Tort Claim filed November 8, 1995 by
<br />Thomas K. Massey, Attorney, Lincoln, Nebraska for Garrett R. Luther against
<br />County of Hall, .Nebrask-a, dlbLa.. Hall County Housing Authority/Western Apartments.
<br />Had-rev{ewed- letter, frQ~_th~__County Attorney's office recommending the claim
<br />I,edeniedbecause ~the Hall County Housing Authority is separate body corporate,
<br />and is not an agency or department of County of Hall.
<br />Motion by Stelk, seconded by Rosenkotter to deny the Tort Claim for
<br />Garrett R. Luther as recommended by County Attorney's office. Abernethy,
<br />Landis, Leslie, Quandt, Rosenkotter and Stelk voted yes, none voted no, with
<br />Hartman absent. Motion Approved.
<br />
<br />Deputy County Attorney Janulewicz was present. He requested delay on action
<br />on Substance Abuse Policy for Handibus. Izola Sargent is to be at meeting
<br />and has requested some changes be made in wording, according to State Depart-
<br />ment of Roads.
<br />
<br />Board members questioned Janulewicz on claims from Merit Commission that has
<br />incurred and Sheriff Fosket to be at meeting later today. Also questioned
<br />the policy for Handibus in relation to the NIRMA policy and testing for both
<br />policies in regard to costs.
<br />
<br />Izola Sargent, Handibus Director arrived during discussion.
<br />
<br />Supervisor Hartman arrived at 9:15 A.M.
<br />
<br />Izola Sargent stated the testing has not been determined yet, will be placed
<br />for contract, effective date January 1, 1996. All employees will be tested
<br />before hired for the Handibus Program.
<br />Attorney Janulewicz will make needed corrections to the policy and return
<br />later with policy for approval by County Board Members.
<br />
<br />Supervisor Landis questioned Attorney Janulewicz about the Homestead Appeal
<br />on agenda for later today and if County Board can change valuation 9f property.
<br />
<br />PUBLIC PARTICIPATION:
<br />
<br />Ted . Hunt:.,.( B&T Vending, Broken Bow, Nebraska, spoke in regard to letter County
<br />Board had-received from employees at Social Service Department in regard to
<br />vending machines located at their offices. He has more new machinery coming
<br />next week. Complaints should be made directly to him as he would like to meet
<br />with the people to resolve the problems.
<br />Motion by Landis, seconded by Stelk to authorize Ellen Merrill, County
<br />Board Assistant to notify Mr. Hunt immediately when receives a complaint
<br />on vending machines. Hartman, Landi~, Leslie, Quandt, Rosenkotter and
<br />Stelk voted yes, Abernethy voted no,lJecause she felt notice should be only

<br />Marie Delgatto, 906 S Locust, Grand Island, spoke in regard to jail inmate
<br />not allowed to wear his boots at the jail because of metal shanks which she
<br />states there are none. She works for Wayne's Pawn Shop and sells the Harley
<br />Davidson boots in question. Discussion followed. She also spoketQ
<br />board members in regard to ankle injury at jail during visitation when she
<br />slipped on pieces of paper on floor. Discussion followed.
<br />
<br />Supervisor Landis commented the Board of Corrections should be reduced into a
<br />committee and if needs more complete decision, then refer to the full Board
<br />of Corrections.
<br />Discussed the forms to file with Safety Committee. Determined the Safety
<br />Committee incident reports should be on site in all County locations for
<br />immediate action to be forwarded to Board Assistant's Office.
