<br />95 ;:"-. /~ <br />HALL COUNTY BOARD OF SUPERVISORS MEETING - JANUARY 24, 1995 <br /> <br />The Hall County Board of Supervisors met at 9:00 A.M. from adjourned <br />session and by published call with Chiarman Irene Abernethy presiding. <br /> <br />.~. <br /> <br />.!! <br /> <br />Present on roll call were Irene Abernethy, Richard Hartman, Robert <br />Leslie, Gary Quandt, Judy Rosenkotter and Tammie Stelk. Margaret <br />Landis was absent. <br /> <br />Invocation was given by Rev. Dennis Hahle, Messiah Lutheran Church. <br />Pledge of Allegiance was given. <br /> <br />Minutes were approved as received after corrections made by Abernethy <br />with a motion made by Quandt and seconded by Hartman. <br /> <br />Jerry Janulewicz, Deputy County Attorney, presented a resolution <br />authorizing the conditional use permit for Emil Schaaf for the <br />mining and pumping of sand and gravel. This item was a carryover <br />from the week before with the public hearing on January 3, 1995. <br />Motion made by Hartman, seconded by Quandt to approve resolution #1612. <br />Aberenthy, Hartman, Leslie, Quandt, Rosenkotter and Stelk voted yes, <br />Landis was absent. <br /> <br />RESOLUTION # I ~ / ~ <br /> <br />A RESOLUTION AUTHORIZING THE CONDITIONAL USE OF THE EAST <br />HALF OF THE SOUTHEAST QUARTER (E 1/2 SE 1/4) AND THAT PART <br />OF LOT TWO (2) ON ISLAND SOUTH OF THE HALF SECTION LINE, <br />SECTION TEN (10), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) <br />WEST OF THE 6th P.M., HALL COUNTY, NEBRASKA. <br /> <br />WHEREAS, Emil Schaaf, hereinafter referred to as <br />"applicant," is the owner of the following described real <br />estate, to wit: <br /> <br />The East Half of the South east Quarter (E1/2 SE1/4) <br />and that part of Lot Two (2) on Island south of the <br />half section line, Section Ten (10), Township Ten (10) <br />North, Range Ten (10) West of the 6th P.M., Hall <br />County, Nebraska; and <br /> <br />WHEREAS, the above-described real estate is located <br />within the AG-1 Zoning District; and <br /> <br />WHEREAS, Applicant has presented an application for a <br />Conditional Use' Permit to the Hall County Board of <br />Supervisors requesting a Conditional Use Permit for the <br />mining and pumping of sand and gravel from the land; and <br /> <br />WHEREAS, the Hall County Board of Supervisors finds <br />that such use is authorized under the conditional uses <br />within the AG-1 District; that such use, as limited herein, <br />will not adversely affect the public interest; and that said <br />Board is empowered under the Zoning Resolution to permit <br />such conditional use. <br /> <br />NOW, THEREFORE, the Hall County Board of SuperVisors <br />hereby grants to applicant a Conditional Use Permit to usa <br />the above described real estate for the mining and pumping <br />of sand and gravel from the land SUBJECT TO THE FOLLOWING <br />CONDITIONS, RESTRICTIONS AND LIMITATIONS: <br /> <br />(A) All dead trees, rubbish and debris, if any, must <br />be cleared from the above described real estate as soon as <br />practical and said real estate must, at all times, be kept <br />in a clean and neat condition. <br /> <br />(B) No trash, rubbish, debris, broken concrete, dead <br />trees, lumber, bricks, refuse or junk material of any nature <br />whatsoever shall be dumped, placed or located upon said real <br />estate. <br />
