The County hereby designates the Series 1996 Bond as one of its "qualified tax-exempt obligations" pursuant to Section 265(b)(3)(B)(i)(Ill) of the Internal Revenue Code of 1986, as amended, and covenants and warrants that it does not reasonably anticipate issuing bonds or other interest bearing obligations during calendar 1996 in an amount in excess of $10,000,000, including for such purposes in such amount any bonds or other interest bearing obligations issued by any governmental units subordinate to the County. The County hereby agrees that it will not take any action on its part which would have the effect of causing the interest on the Series 1996 Bond to be includable in gross income for federal income tax purposes, it being understood that such status may be affected by actions in violation of the tenns of the Loan Agreement, not under the control of the County. Section 11. If any section, paragraph, clause or provision of this Resolution or any of the documents referred to herein shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this Resolution or of said documents. Section 12. This Resolution does hereby incorporate by reference the provisions of the Act as fully as if the same were set out herein. Section 13. All other resolutions or orders, or parts thereof, in conflict with the provisions of this resolution are to the extent of such conflicts hereby repealed. Section 14. Returned to session at 10:22 a.m. Continued discussion on the Conditional Use Permit for Bosselmans Inc. Motion by Landis, seconded by Long to approve the conditional use permit with change to 5 years instead of 10 years. Landis and Leslie voted yes, Hartman, Long, Quandt and Stelk voted no, Abernethy abstained. Motion failed, on 2 yes, 4 no and 1 abstain vote. Hartman stated the Conditional Use Committee should meet with City represent- atives, Bosselmans and others to work out a solution and County Board recess today's meeting until Thursday to take action on Conditional Use Permit. Conditional Use Committee to meet Wednesday, November 20 at 9:00 a.m. and Board will meet at 11:00 a.m. on Thursday, November 21.
