S7PD-STPN-TMT-11-2(114) <br /> CONTROL NQ.42032 <br /> WOOD RIVER W�ST <br /> HALL GOUNTY <br /> CITY OF WOQD RIVER <br /> STATE OF NEBRASKA, DEPAR7MEN7 OF ROAbS <br /> THIS SUPPLEMENTAL AGREEMENT made and entered into by and between the <br /> City of Wood River, hereinafter referred to as the"City", the County of Hall, Nebraska, <br /> hereinafter referred to as the"County", and the State of Nebraska, Department of Roads, <br /> hereinafter referred to as the"State",the three parties hereinafter sometimes referred to <br /> collectively as"the Parties", <br /> WITNESSETH: <br /> WHEREAS,the parties hereto entered into an Original Agreement SL0403, executed by <br /> the City on November 19, 2004, by the County on November 30, 2004, and by the State on <br /> January 28, 2005, providing for the construction of a new viaduct on Highway 11 over the Union <br /> Pacific F2ailroad tracks and U.S. Highway 30,the closure of two at-grade railroad crossings,the <br /> relinquishmant of segments of old Highway 11, and the construction of a new pedestrian <br /> structure over the Union Pacific Railroad, hereinafter referred to as the"Project", under the <br /> designation of Project No. STPD-STPN-TMT-11-2(114); and 5upplemental Agreement No. 1 <br /> executed by the City on March 4, 2009, by the Caunty on March 3, 20D9, and by the State an <br /> April 1, 2009, providing for clarifying jurisdictional responsibility of the roads relinquished to the <br /> City and County, and <br /> WHEREAS, it now becomes necessary that said agreement be supplemented to provide <br /> for relinquishment cost, and <br /> WHEREAS, the State will fund in its entirety the cost of relinquishing Nebraska <br /> Highway 11 to the Gity and County, and <br /> WHEREAS,the State has, according to its relinquishment policy, programmed a project <br /> to resurface Nebraska Highway 11 in ord�r to relinquish an acceptable roadway to the City and <br /> the County,and <br /> WHEREAS, Gity and County have requested State provide a lump sum payment in lieu <br /> of performing the relinquishment resurfacing, and <br />
