Mr. Schuppan questioned if the claim is denied would there be an issue on a 1099 and it would <br /> not affect it because the 1099 is based on when the payment is received. <br /> Gary the board deals with time lines and if the board made a make exception would this hold up <br /> in court. Mr. Zitterkopf stated that based on the state statute he agrees with the wording that it <br /> "shall" be denied. <br /> Stacey Ruzicka stated that she called Clerk of the District Court Valorie Bendixen and she <br /> stated that there is smaller pool of attorneys for the mental health board hearings and Mr. <br /> Fogarty is used because of his experience. <br /> Pam asked if the baard could ask the state attorney general to address this issue and Mr. <br /> Zitterkopf stated the board would not get an opinion an a civil matter. Discussion was held. Mr. <br /> Schuppan questianed if he has been paid since 2010 and County Clerk Canley stated that he <br /> has been paid. <br /> Arnold questioned if there would be a risk if the board makes an exception and pays this claim <br /> but would deny others? Mr. Zitterkapf answered yes. <br /> Arnold made a motion and McFarland seconded to pull this claim for further clarification from <br /> the state auditor and bring it back in 2 weeks. <br /> Mr. Purdy stated that he does not think the state auditor will tell us if we should pay this claim it <br /> is up to the County Board. <br /> Ms. Lancaster questioned if this would be an audit exception. <br /> Mr. Quandt noted that this is a bill over 90 days old and it afFects the budget if it isn't submitted <br /> and paid. <br /> The vote on the motian to pull this claim for clarification was held. Arnold, McFarland and <br /> Schuppan voted yes and Lancaster, Quandt, Purdy and Ziola voted no. Motion failed. <br /> Ziola made a motion and Purdy seconded to deny the claims to Jerry Fogarty for the mental <br /> health services provided that were over 90 days old with regret. Arnold, Lancaster, McFarland, <br /> Purdy, Quandt, Schuppan and Ziala all voted yes and none voted no. Motion carried. Notice of <br /> the denial must be sent in 5 days. <br /> Lancaster noted that the amount was not the issue it is the state statute. She asked if the board <br /> had any other claims to discuss. <br /> Quandt made a motion and Arnold seconded to apprave the bi weekly pay claims and the <br /> regular claims except for the Offce Net claim. Arnold, Lancaster, McFarland, Purdy, Quandt, <br /> Schuppan and Ziola all voted yes and none voted no. Motion carried. <br /> Quandt made a motion and Ziola seconded ta approve the Office Net claim. Mr. McF'arland <br /> stated that he will abstain because he has a business relationship with Office Net. Arnold, <br /> Lancaster, Purdy, Quandt, Schuppan and Ziola all vated yes and none voted no.
