Motion carried. <br />RESOLUTION # 9&- ()o/7 <br /> <br />A RESOLUTION DELEGATING AUTHORITY TO TEMPORARILY CWSE OR <br />PLACE VEIDCLE WEIGHT LIMITATIONS ON COUNTY ROADS <br /> <br />WHEREAS, the County of Hall is responsible for the maintenance and repair of county roads <br />within Hall County; and <br /> <br />WHEREAS, Neb.Rev.Stat. sec. 39-1801 grants to county boards the authority to temporarily <br />close county roads when justified by necessity in order to provide for the public safety, and to <br />place limitations on the weight of vehicles using county roads when necessary for reasonable <br />periods where the subgrade or pavement of such roads is weak or materially weakened by climatic <br />conditions; and <br /> <br />WHEREAS, Neb.Rev.Stat. sec. 39-1801 furtherpennits county boards to delegate the above <br />authority within the respective counties; and <br /> <br />WHEREAS, the Hall County Public Works Director and the Assistant County Public Works <br />Director have appropriate education, training, and experience to entrust with and delegate to the <br />authority to temporarily close county roads or to place load limit restrictions thereon as set forth <br />herein. <br /> <br />NOW BE IT RESOLVED BY THE HALL COUNlY BOARD OF SUPERVISORS that the <br />Hall County Public Works Director and, in the absence of the County Public Works Director, the <br />Assistant County Public Works Director be and hereby are authorized to temporarily close and <br />suspend travel over any county road within the county whenever any such road or part thereof is <br />impassable or unusually dangerous to travel, whenever it becomes necessary because of <br />constmction or maintenance work to suspend all or part of the travel on any such road, or <br />whenever justified by necessity in order to provide for the public safety, or the weight limitations <br />of wheel and axle loads as provided by statute may be restricted to the extent deemed necessary <br />for a reasonable period where the subgrade or pavement of any such road is weak or materially <br />weakened by climatic conditions. Whenever any such road is closed, travel suspended, or weight <br />limitations of wheel and axle load are imposed, the such action shall be reported to the Hall <br />County Board of Supervisors within a reasonable time thereafter. The action of the Public Works <br />Director or Assistant Public Works Director may be reversed, modified, or suspended by <br />affirmative vote of the Hall County Board of Supervisors. <br /> <br />BE IT FURTHER RESOLVED that the of the Hall County Board of Supervisors, the Hall <br />County Public Works Director, and the Assistant County Public Works Director shall comply <br />. . <br />
