Quandt made a motion which was seconded
by Landis to approve the minutes as received. Quandt, Landis,
Hartman, Stelk, Leslie, Abernethy, and Rosenkotter voted yes and
none voted no. Motion carried.

COUNTY ATTORNEY: Deputy County Attorney Jerom Janulewicz
distributed a copy of a January 6, 1995, opinion he had sent the
Board regarding the submission of the South Locust Street Project
to a vote of the electorate. He explained this opinion regarding
~23-276. This issue was discussed.

Landis suggested deciding the ballot issue before the inter local
agreement. Rosenkotter made a motion which was seconded by
Abernethy to call for the orders of the day. Stelk said there
was no need for this motion because the inter local agreement was
placed on the agenda first following a vote of the Board last
Tuesday and the ballot issue was placed on the agenda by Quandt
on Friday morning. She said the Secretary of State told the
Election Commissioner that no statute allows for a countywide
petition to place items on the ballot so there's no way to
determine how many signatures would be required for such a drive.
The issue was discussed.

INTERLOCAL AGREEMENT FOR CONSERVATION EASEMENT AND OVERLAY ZONES:
Rosenkotter made a motion which was seconded by Abernethy to
approve the inter local agreement for conservation easements and
overlay zones and authorize the Chair to sign it. The issue was
discussed. Quandt, Landis, and Hartman voted no, and Stelk,
Leslie, Abernethy, and Rosenkotter voted yes. Motion carried.

BALLOT ISSUE FOR MAY PRIMARY ELECTION--I-80 AND SOUTH LOCUST
INTERCHANGE: No discussion or action.

1
