RFSOLUTION#12- !� �_ <br /> A RESOLUTION DENYING A PETYTION TO CLOSE <br /> A PORT�ON OF ELM ISLAND ROAD. <br /> WHEREAS, on Septcmber 11, 2012, the Hall County Board of Supervisors received a <br /> petition from the Platte River Whaoping Crane 1Vlaintenance Trusi to close a portion of Elm Island <br /> Road located in the SE 1/4 of Section 2S, Township 10 North, Range 10 West in Hall County, <br /> Nebraska; arid <br /> WHEREAS, on Septembcr 25, 2012, the Hall County Board of Supervisors, by resolution, <br /> directed the Hall County Highway Superintendent to conduct a study of the use of said portion of <br /> Elzx� [sland Road in Hall County, Nebraska, and to subrnit a report of said study, together witla his <br /> written recomrnendation as to the road's vacation or abandonrnent, to the Hall County Board of <br /> Supervisors within 30 days of said date; and <br /> WHEREAS, on October 23, 2012, the Hall County Board of Supervisors, having received <br /> the aforernentioned written report of the Hall County Highway Superintendent, scheduled a public <br /> hearing on tlae petition to vacate or abandon that portion af Elm Island Road located in the SE l/4 of <br /> Sectian 2S, Township 10 North, Range 10 West in Hall County, Nebraska; and. <br /> WHEREAS, oa� Navember 20, 2012, at 10:00 o'clock a.m., after notice as providcd for by <br /> law, the Hall County Board of Supervisors conducted a public hearing on the petition of the Platte <br /> River Whooping Crane Maintenance Trust to close a portion of Elm Island Road located in the SE <br /> 1/4 of Section 25, Township 10 North, Range 10 West in Hall County, Nebraska; and <br /> WHEREAS, on December 4, 2012, while in regular session and after natice as provided by <br /> law, the Hall County Baard of Supervisors discussed and took aciion on the aforementioned petition <br /> ta close a portion of Elrn Island Road and, further, directed the preparation of a resolutioa� reflecting <br /> the Board's chosen course of action. <br /> NOW, THEREFORE, BE IT RESOLVED that the public intcrest is best served as follows: <br /> (1) that the petition of the Platte River Whooping Crane Maintenance Trust to close, vacate ar <br /> abandon that portion of El��n Island Road extending wcst frotn Highway 281 for <br /> approximately 1.35 miles is hereby denied; <br /> (2) that the petition of thc Platte River Whooping Crane Maintenance Trust to erect a gate on <br /> Elm island Road irnmediately west of Highway 2$1 is hereby denied; <br /> (3) that the unautho�ized locked gate that currently exists at the westerly end of ihe <br /> aforelnentioned 1.35 miles of Elm Island Road is hereby authorized ta be maintained by the <br /> Platte River Whooping Crane Maintenance Trust subject to the condition that keys to said <br /> locked gate be provided to the Hall County Hi�hway Superintendent and the District 6 Fire <br /> Board at the request of said partics; <br /> (4) that the easement of the County of Hall, Nebraska, extending approximate 1.65 miles in a <br /> westcrly directian frorn the gate authorized in subparagraph (3) above not be abandoned, and <br /> that the same rcmain the property of the County of Hall,Nebraska. <br />
