<br />U}),)1 Q"\ j ~ f" <br /> <br />RESOLUTION #1 q - D ()q 0 <br /> <br />F19990501 <br /> <br />A RESOLUTION AUTHORIZING THE CONDITIONAL USE OF A TRACT OF <br />LAND LOCATED IN THE NORTHEAST OUARTER (NE 1/4) OF SECTION <br />FIFTEEN (15), TOWNSHIP TEN (10) NORTH, RANGE ELEVEN (11) WEST OF <br />THE 6 tb P.M., HALL COUNTY, NEBRASKA <br /> <br />WHEREAS, Aurora Cooperative Elevator Company, hereinafter referred to as <br />"applicant," is the lessee of a parcel of real estate, containing 2.5 acres, more or less, depicted <br />as Parcel 1 in Exhibit "A", which is attached hereto and incorporated herein by this reference, <br />and the owner of the parcel of real estate, containing 5.7 acres more or less, depicted as Parcel <br />2 in Exhibit "A," both parcels hereafter collectively referred to as the "property;" and <br /> <br />WHEREAS, applicant has made written application to use the property for the storage <br />and retail sale of anhydrous ammonia, liquid and dry fertilizer, and chemical products utilized <br />for agricultural purposes and for storage of tanks and equipment related to the operation of a <br />retail fertilizer and farm supply business; and <br /> <br />WHEREAS, the above described property is located in a district presently zoned for <br />AG-I Agricultural use; and <br /> <br />WHEREAS, the proposed conditional use in a district zoned AG-I is a permitted <br />conditional use pursuant to section 5, paragraph I.e. of the Zoning Resolution of Hall County, <br />Nebraska, as amended; and <br /> <br />WHEREAS, on November 23, 1999, a public hearing on said application was held by <br />the Hall County Board of Supervisors upon due and proper notice of said hearing; and <br /> <br />WHEREAS, at said public hearing the public was given the opportunity to speak in <br />favor of and in opposition to the application for conditional use. <br /> <br />NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, <br />Nebraska, the Hall County Board of Supervisors hereby authorizes the conditional use of the <br />above-described property for the storage and retail sale of anhydrous ammonia, liquid and dry <br />fertilizer, and chemical products utilized for agricultural purposes and for storage of tanks and <br />equipment related to the operation of a retail fertilizer and farm supply business subject to the <br />following conditions: <br /> <br />1. The above described real estate shall be used solely for the storage and retail sale of <br />anhydrous ammonia, liquid and dry fertilizer, and chemical products utilized for agricultural <br />purposes and for storage of tanks and equipment related to the operation of a retail fertilizer <br />and farm supply business. The premises shall be maintained in a neat and clean condition at <br />all times, free of debris and inflammable waste materials. <br /> <br />2. Applicant shall comply with the Hall County Zoning Resolution, Hall County Subdivision <br />Regulations, and Hall County Building Codes with respect to the use of the above-described <br />property. <br /> <br />3. The rights and privileges granted herein may be terminated for any act or acts on <br />noncompliance with the terms and conditions of this resolution. The Hall County Board of <br />
