Q <br />r li'lilQui)oO <br /> <br />~ j 5" C \4 ~ > ,. .9,J brA .0+ <br /> <br />8/2 '1/9 ? <br /> <br />fflTERLOCAL AGREEMENT BY AND BETWEEN <br />THE <br />CENTRAL PLATTE NATURAL RESOURCES DISCTRICT <br />AND <br />THE COUNTY OF HALL <br />FOR MAfflTENANCE OF DRAINAGE DITCHES AT THE <br />CORNHUSKER ARMY AMMUNITION PLANT SITE <br /> <br />TIllS AGREEMENT is made and entered into this _ day of 1999, by <br />and between the Central Platte Natural Resources District, a body politic and corporate, <br />hereinafter referred to as the "District," and the County of Hall, a body politic and corporate and <br />a political subdivision of the state of Nebraska. WITNESSETH: <br /> <br />WHEREAS, the United States Army constructed drainage ditches within the boundaries <br />of the Cornhusker Army Ammunition Plant (CAAP) to provide for adequate drainage within the <br />CAAP;and <br /> <br /> <br />WHEREAS, the CAAP is now an inactive installation and the current mission of the <br />United States Army is to dispose of said facility; and <br /> <br />WHEREAS, maintenance of the above-mentioned drainage ditches is a public concern due <br />to the proximity of private and public property that would be adversely effected by inadequate <br />drainage of the CAAP site; and <br /> <br />WHEREAS, the lnterlocal Cooperation Act, Neb. Rev. Stat. ~13-801, et. seq. provides <br />that units of local government of the State of Nebraska and Nebraska state agencies may enter <br />into agreement for the joint and cooperative exercise of powers, privileges, or authority capable <br />of being exercised by either agency; and <br /> <br />WHEREAS, Neb. Rev. Stat. 913-801 provides that anyone or more public agencies may <br />contract with anyone or more public agencies to perform any governmental service, activity, or <br />other undertaking which each public agency entering into the contract is authorized by law to <br />perform; and <br /> <br />WHEREAS, the County and the District are public agencies as defined by Neb. Rev. Stat. <br />S13-801; and <br /> <br />WHEREAS, the maintenance of adequate drainage IS a matter of public health, <br />convenience and welfare; and <br /> <br />WHEREAS, the County and the District desire to enter into this interlocal agreement to <br />ensure the continued operation and maintenance of drainage ditches located within the boundaries <br />of the Cornhusker Army Ammunition Plant. <br /> <br />1 <br />
