<br />F 19990064 <br /> <br />RESOLUTION #99- ~ () () '=' <br /> <br />A RESOLUTION AUTHORIZING A TEMPORARY CONDITIONAL USE OF A <br />TRACT OF LAND LOCATED IN THE SOUTHWEST QUARTER (SW ~) OF SECTION <br />TWENTY (20), TOWNSHIP TWELVE (12) NORTH, RANGE ELEVEN (11) WEST OF <br />THE 6th P.M., HALL COUNTY, NEBRASKA. <br /> <br />WHEREAS, Werner Construction, a Nebraska Corporation, hereinafter referred to as the <br />"applicant," is the lessee of a tract ofland informally described as: Five (5) acres on the east side <br />of BOth Road approximately 1750 feet south of Highway 2 in the Southwest Quarter (SW ~) of <br />Section Twenty (20), Township Twelve (12) North, Range Eleven (11) West of the 6th P.M., Hall <br />County, Nebraska; and <br /> <br />WHEREAS, applicant has made a written application to use the above-described tract for <br />the erection and operation of a portable asphalt mixing plant to be used for the manufacture of <br />paving material for State of Nebraska project EACNH-EACBR-2-4(107) Cairo West; and <br /> <br />WHEREAS, a public hearing on said application was held January 26, 1999, by the Hall <br />county Board of Supervisors following due and proper notice; and <br /> <br />WHEREAS, the Hall County Zoning Resolution permits the granting of a non- <br />conforming conditional use of property for a period not to exceed two years. <br /> <br />NOW BE IT RESOLVED that the application of applicant for a temporary conditional <br />use of the above-described property is hereby granted subject to the following terms and <br />conditions: <br /> <br />1. The applicant may erect and operate a portable asphalt mixing plant upon said property for <br />the manufacturing of road paving material for the above.described project. ; <br />2. This resolution of conditional use shall be valid upon adoption by a majority vote of the <br />members of the Hall County Board of Supervisors and shall terminate upon the earlier of <br />completion of the above-described project or two years from the date of adoption. <br />3. The premises shall be maintained in a clean, neat and orderly condition. <br />4. Equipment, rolling stock, and vehicles shall not be stored or parked within 60 feet of the <br />public road right of way adjacent to the above-described tract. <br />5. Applicant shall comply with all applicable state and federal laws, rules, and regulations <br />pertaining to air and water quality. The applicant shall not use the property in such a manner <br />as to result in a nuisance to adjoining landowners or the general public. <br />6. Applicant shall comply with the Hall County Zoning Resolution and County Building Codes <br />with respect to the use of the above-described property. <br />7. Throughout the ten'n of this permit and upon its termination, applicant shall maintain all <br />county roads used by applicant, its subcontractors, and suppliers as haul roads and/or roads <br />used for transporting equipment and materials to or from the above-described tract. Such <br />maintenance shall include, but shall not be limited to, maintenance and repair of asphalt road <br />
