Stelk made a motion and Lancaster <br />seconded to proceed with the remodeling at the safety center and <br />to refer it to the audit committee for bid specifications. <br />Arnold, Hartman, Jeffries, Lancaster, Landis, Logan and Stelk all <br />voted yes and none voted no. Motion carried. The project will <br />need to have bid specifications and have them approved by the <br />county board. <br /> <br />COUNTY ATTORNEY - DISCUSSION AND ACTION ON SOUTH LOCUST STREET <br />PROJECT RIGHT-OF-WAY AND CONSERVATION EASEMENT: Deputy County <br />Attorney Jerry Janulewicz stated that in the interlocal <br />cooperation agreement between the State of Nebraska, County of <br />Hall and the City of Grand Island. It provides that the purchase <br />of the conservation easements will be funded 80% by federal <br />reimbursement and 20% will be paid by the County and City <br />equally. The appraisals have been completed with a cost of <br />$629,530.00 for the right-of-way and $152,407.00 for the <br />conservation easements. The preliminary figures on the <br />conservation easement have come in low but the State Department <br />of Roads does not have much experience in this type of land <br />acquisition. <br /> <br />Janulewicz explained the federal highway funds would cover 80% of <br />the coast of acquiring conservation easement through purchase at <br />the appraisal amount or by condemnation. If the county imposed a <br />conservation overlay zone the federal highway administration will <br />not approve using funds for inverse condemnation damages because <br />of the zoning action. Hartman expressed his concern on the <br />amount that has been offered to the land owners. Stelk pointed <br />out that Janulewicz requested assistance in the condemnation <br />proceedings and that the county attorney's office may have a <br />conflict of interest in this matter. <br /> <br />Hartman stated that the land owners only want the fair market <br />value and damages for the conservation easements. John Amick, <br />410 Amick Avenue, Doniphan, Nebraska, who is representing some of <br />the land lowners, stated these right-of-way and conservation <br />easement purchases will affect the land owners forever. Logan <br />stated that the people can still use the land but not for <br />commercial or industrial development. Amick requested that the <br />county board release the appraisals to the land owners. Deputy <br />County Attorney Jerry Janulewicz advised not to release the <br />appraisals. This matter was tabled to allow for the gravel bid <br />opening. <br /> <br />10:00 A.M. GRAVEL BID OPENING: Logan made a motion and Stelk <br />seconded to open the gravel bids. Arnold, Hartman, Jeffries, <br />Lancaster, Landis, Logan and Stelk all voted yes and none voted <br />no. Motion carried. <br />
