RESOLUTION #12- 0 ( �•j . <br /> AN AMENDED RESOLUTION AUTHORIZING THE CONDITIONAL USE OF PART OF <br /> THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER (NW 1/4 NE 1/4) <br /> OF SECTION THIRTY (30), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) <br /> WEST OF THE 6 P.M., HALL COUNTY, NEBRASKA <br /> WHEREAS, Mid - Nebraska Aggregate, Inc., hereinafter referred to as "applicant," is the <br /> licensee with respect to the following described real estate, to wit: <br /> PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER (NW 1/4 NE <br /> 1/4) OF SECTION THIRTY (30), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) WEST <br /> OF THE 6 P.M., HALL COUNTY, NEBRASKA; and <br /> WHEREAS, Ron Follrner, hereinafter referred to as "owner," is the record title owner of <br /> the above - described real estate; and <br /> WHEREAS, the above- described real estate is located within the AG -R Zoning District; <br /> and <br /> WHEREAS, Applicant has presented an application for a Conditional Use Permit to the <br /> Hall County Board of Supervisors requesting a Conditional Use Permit for a temporary asphalt <br /> batching plant; and <br /> WHEREAS, on January 31, 2012, a public hearing on said application was held at the <br /> regular meeting of the Hall County Board of Supervisors following notice of the same as <br /> provided by statue; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under <br /> the conditional uses within the AG -R District; that such use, as limited herein, will not adversely <br /> affect the public interest; and that said Board is empowered under the Zoning Resolution to <br /> permit such conditional use. <br /> NOW, THEREFORE, the Hall County Board of Supervisors grants to Applicant a <br /> Conditional Use Permit to use the above described -real estate for a temporary asphalt batching <br /> plant SUBJECT TO THE FOLLOWING CONDITIONS, RESTRICTIONS AND <br /> LIMITATIONS upon the use of the aforesaid property by Applicant and Owner, and their <br /> assigns, permitees, licensees, tenants, and contractors: <br /> 1. This Conditional Use Permit shall be in conjunction with an existing Conditional Use <br /> Permit for pumping of sand and gravel on the same land and subject to all of the existing terms <br /> and conditions of said permit. <br /> 2. Applicant shall erect and maintain traffic control devices, at a minimum, prior to all <br /> curves and place a flashing barricade at the entrance to the driveway, or as shall otherwise be <br /> required /permitted by the Nebraska Department of Roads. <br />
